Welcome to Instatize. By accessing or using our website and application at instatize.app, you agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

1. Service Description

Instatize is a browser-based design tool that allows users to create social media graphics, YouTube thumbnails, promotional ads, and other branded visuals by uploading images and applying text overlays, style presets, and color palettes.

2. User Accounts

Account creation and authentication are handled through Auth0. You are responsible for maintaining the security of your login credentials. You must provide accurate information when creating an account.

3. Intellectual Property & Content Ownership

Your Content: You retain full ownership of any images you upload and any designs you create using Instatize. We do not claim any rights to your content.
Our Service: The Instatize application, including its code, design presets, layout algorithms, and branding, is the intellectual property of Instatize and is protected by copyright law.
Commercial Use: Designs you create with Instatize may be used for any commercial or personal purpose.

4. Payments & Pricing

Payments are processed securely through Stripe. We never see or store your credit card details. Instatize offers two purchase options:

Single Export ($1.99): A one-time purchase that grants one watermark-free, high-resolution download.
Pro Subscription ($5/month): A recurring monthly subscription providing unlimited watermark-free downloads and access to the brand logo upload feature for the duration of the subscription.

Prices are in USD and may be updated with advance notice. Current pricing is always available on our pricing page.

5. Refund Policy

All purchases are non-refundable. Because digital assets are delivered immediately upon purchase, we do not offer refunds on the $1.99 single-use credits or on subscription fees. By making a purchase, you acknowledge that you receive immediate access to digital content and waive any right to a cooling-off period refund.

6. Subscription Cancellation

You may cancel your Pro subscription at any time through the Account portal (powered by Stripe). Cancellation takes effect at the end of your current billing period — you will retain access to Pro features until then. No partial refunds are issued for unused portions of a billing cycle.

7. Acceptable Use

You agree not to use Instatize to:

Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Infringe on the intellectual property rights of others.
Attempt to reverse-engineer, decompile, or extract the source code of the application.
Use automated tools to scrape or interact with the service in unauthorized ways.

8. Service Availability

We strive to keep Instatize available at all times but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.

9. Limitation of Liability

Instatize is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Instatize and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

10. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the service after changes constitutes acceptance of the revised terms.
